Policy Statement
As used herein, “seller” refers to DCIC TECH. “Purchaser” refer to the purchaser of DCIC TECH products. By purchasing DCIC TECH products, purchaser agrees to seller’s terms of sale as set forth herewith. No modifications or alterations of these terms and conditions are authorized by any persons other than a designated Officer of DCIC TECH. This statement of general terms and conditions of sale includes all products listed in the current price sheet. This statement is in lieu of any other policy, expressed or implied, and no representative or person is authorized to assume for DCIC TECH. any other liability in addition to this policy without the expressed written consent of DCIC TECH. Prices, designs, material, specifications, and the listed Terms and Conditions are subject to change without notice. Possession of a price schedule or catalog is not to be construed as an offer to sell the products listed therein. All orders are subject to acceptance. All orders for Premium product of $2500 or more must be accompanied by a faxed or mailed purchase order. No exceptions will be allowed.
Specific Terms of Sale
The standard terms of sale may change during the year; DCIC TECH reserves the right to make changes, if necessary, without prior notice to our customers.
Our lowest prices guaranteed but prices are subject to change without notice. When price changes are necessary, DCIC Tech will make every effort to provide advance notice, allowing reasonable time for customers to make adjustments. Prices do not include shipping and handling charges.
Past Due Accounts
All accounts are past due after 30 days from DCIC TECH date of invoice. Past due accounts are subject to a finance charge of 11/2% per month, or annual percentage rate of 18%. Seller reserves the right to suspend open account privileges on any account which, in accordance with seller’s terms of sale, is determined to be past due.
Taxes
All Customers residing in New Jersey and Florida will be charged sales and/or use taxes. For purchases shipped to other states, taxes are the responsibility of the purchaser.
Returned Merchandise
Merchandise shipped according to purchaser’s order cannot be returned without express written approval from a designated Officer of DCIC TECH. No merchandise will be accepted in any case after 30 days from date of invoice. If approved for return, all return freight charges are the responsibility of the purchaser. A copy of the original invoice must accompany all returned shipments. A 15% restocking charge will be assessed on all returns. Special Orders may not be returned.
Damaged Goods
All merchandise shipped by DCIC TECH. is carefully packed and inspected before shipment. If goods are damaged in transit, it is purchaser’s responsibility to file a claim for damages with the appropriate carrier. Damage to a shipping carton or Shortages must be noted on the freight bill received, and a claim should be filed immediately with the delivering driver. Concealed damage claims must be made within 24 hours. Seller will provide all assistance possible to help secure purchaser’s adjustment and receive purchaser’s new shipment as soon as possible.
Shipping and Delivery
Orders for in stock items received by 12:00 p.m. (EST) are shipped the same day. Most items are shipped via UPS Ground. Some items are too larger or heavy to be shipped via UPS. Therefore these items will be shipped via truck. All truck freight contract discounts are passed on to our customers. Truck drivers will not assist in bringing the items into your facility.
Warranty and Limitation on Liability
The following warranty is made in lieu of all other warranties, expressed or implied, or for merchantability of fitness for a particular purpose: All goods are manufactured to sellers quality requirements. Any goods proved defective due to materials or workmanship will be replaced or the purchase price refunded, but in no event will seller be responsible for damages in excess of the purchase price. Seller will not be liable for any damages, whether direct, incidental, special or consequential in excess of the value of the item which is claimed defective. Seller will not be liable for any purchasers acts or omissions, such as failure to acknowledge and/or follow package instructions for product usage. In the event of any dispute regarding DCIC TECH products or their use, all such disputes will be settled first by informal mediation. If no agreement is reached, all further disputes will be settled in arbitration under the Commercial Rules of the American Arbitration Association, applying the law of the State of Florida. By purchasing seller’s products, purchaser agrees to this dispute resolution process. Note: Product is suitable for synthetic fibers only; not recommended for natural fibers.
